These Terms of Service (“Terms”) govern your access to and use of the Hü Performance App, the website www.huperformance.com, and any related digital services, content, features, or digital products (collectively, the “Services”) provided by Hü Performance LLC (“Hü Performance,” “we,” “our,” or “us”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

You must be at least 18 years old to use the Services, or at least 13 years old with parental or guardian consent, where permitted by law. The Services are not intended for children under the age of 13, and users under 13 may not access or use the Services.

Hü Performance provides Strength training and performance programming; Educational fitness content; Digital tools for logging workouts and tracking performance; and Related wellness and training resources. The Services may be delivered through a mobile application, website, or other digital platforms.

All content provided through the Hü Performance app and Services is for educational and informational purposes only. The Services are not intended to diagnose, treat, cure, or prevent any medical condition, and do not constitute Medical advice, Physical therapy treatment, Rehabilitation services, nor a provider–patient relationship

You acknowledge and agree that participation in any exercise program involves inherent risks. You are solely responsible for determining whether the exercises, programs, or information are appropriate for you. You should consult a qualified healthcare professional before beginning any exercise or training program. Use of the Services is at your own risk.

Assumption of Risk & Release of Liability

By using the Services, you acknowledge that physical activity involves risks including, but not limited to, injury, illness, or death. You voluntarily assume all risks associated with using the Services and agree to release and hold harmless Hü Performance, its owners, contractors, employees, and affiliates from any claims or liabilities arising from your participation, except where prohibited by law.

You may be required to create an account to access certain features. You agree to provide accurate and current information, maintain the confidentiality of your login credentials, and notify us immediately of any unauthorized access. You are responsible for all activity that occurs under your account.

Payments, Subscriptions & Billing

If you purchase a subscription or paid service, fees are billed in advance and are non-refundable unless otherwise required by law. Subscription terms, pricing, and renewal details will be disclosed at the time of purchase. You are responsible for managing subscriptions through your app store or payment provider

Intellectual Property

All content, including but not limited to Training programs, Videos, text, graphics, logos, App design and functionality is owned by or licensed to Hü Performance and protected by intellectual property laws. You may not copy, modify, distribute, sell, or exploit any content without prior written permission.

You agree not to use the Services for unlawful purposes, share or misuse content in a way that infringes intellectual property rights, attempt to access restricted areas or systems, or interfere with the operation or security of the Services.
